Domestic PNG connection

TERMS AND CONDITIONS FOR SUPPLY OF PIPED NATURAL GAS TO DOMESTIC CUSTOMERS.

1.Definitions:

1.1 "Supplier" or "Entity" means Indian Oil Corporation Limited or IOCL.
1.2 "Applicant" or"Customer" means the applicant for a domestic piped Natural Gas (PNG) connection.
1.3 "PNGRB" means Petroleum and Natural Gas Regulatory Board.
1.4 "PNG Equipment" or "PNG Installation" means equipment and installations used for providing PNG connection as defined in Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008 (hereinafter referred to as PNGRB Regulations 2008).
1.5 "SCM" (Standard Cubic Meter) of GAS, means a quantity of GAS required to fill one (1) cubic meter of space when the GAS is at an absolute pressure of seven hundred and sixty (760) millimeters of mercury and a temperature of fifteen (15) degrees Celsius.
1.6 "Security Deposit" means interest free refundable amount collected from the Customer, at the time of providing PNG connection towards the safe keeping of the equipments installed/to be installed at the premises of the Customer.
1.7 "Households" means a family or group of people living together in a dwelling unit having common Kitchen.
1.8 "Business Partner Number" or "BP Number" is a system-generated number for individual Customer after successful payment of Security Deposit and other prevailing charges.

2. Supplier's Rights and Obligations

2.1 After receipt of the duly completed registration form, technical feasibility will be conducted of the premises of Customer. Once technical feasibility is confirmed, Customer will deposit interest free refundable Security Deposit, the Supplier shall commence to take steps to provide the PNG connection to the Customer. The Supplier shall make all efforts as a prudent City Gas Distribution company to install the connection within reasonable time from the date of registration, subject to the availability of access to the Customer’s premises.
2.2 In the event of any delay, due to non-availability of requisite permissions from land owning agencies of the area/ society, the Customer may exercise the option to ask for the refund of their Security Deposit. The Supplier shall refund the interest free Security Deposit in the event of non-feasibility of providing the PNG connection to the Customer due to technical reasons, which the Supplier may discover at the time of execution of the work of installation of the connection.
2.3 The Supplier shall supply the gas at a pressure of 21 millibar to all the domestic Customers and maintain the maximum flow-rate of 0.75 SCM per hour for kitchen application only. However, the flow-rate may change for any additional application(S) as referred to in clause 2 under the head "General".
2.4 The Supplier reserves the right to select safe and best possible pipeline route to provide PNG connection to individual residential units having necessary safety and statutory clearances.
2.5 The Supplier shall convert the existing LPG burners of Customer's stove (up to four burners) to make it compatible for use on PNG for the first stove/ appliance. Any subsequent conversions would be carried out on payment of applicable charges as prevailing at the time of receipt of the request.
2.6 Meter reading shall be taken during the period commencing 10 days prior to the last date of respective billing cycle. Bi-Monthly bill shall be raised on the Customer on the basis of actual meter reading converted into standard cubic meter (SCM) by applying correction factor. In case, even after best efforts the meter reading is not recorded due to any reason at Customer's end the Entity will send a provisional bill of based on average consumption of the last six billing cycles and the difference in the amount if any, will be adjusted in the next bill on the basis of actual meter reading obtained. In such case if the Customer desires the bill based on actual meter, the Customer may inform the current meter reading along with the photograph of the stated meter reading to the Supplier within 5 days from the last date of respective billing cycle through email: PNG@Indianoil.In or through letter containing the complete details including the meter number and Business Partner number.
2.7 The PNG connection shall be issued only in name of the Applicant as per point 1 above. Extension of GI pipe/ copper tubing/ additional connection(s), within a Household can be provided with extra charges as per prevailing rates. Extension of the connection, to another Household within the same premises shall be considered as a new PNG connection, for which separate application is to be made.
2.8 The modification of existing PNG installation may be carried out on request of the Customer along with the payment of applicable charges (Non-Refundable) as prevailing at the time of receipt of such request. Acceptance of any such request for modification is subject to conformity to relevant technical and safety standards.
2.9 If the banking instrument issued by the Customer gets dishonored for any reason, administrative charges of Rs. 200/- shall be levied and recovered from the Customer in addition to interest if any, without prejudice to the right of the Supplier to initiate appropriate legal proceedings and banker's charges against the Customer for the said dishonor.
2.10 The Supplier shall not use Customer information obtained for a purpose other than for which it was obtained. The Supplier shall not disclose the Customer’s information to any person/entity other than the Petroleum and Natural Gas Regulatory Board (PNGRB), Central and State Governments and other statutory authorities, without the consent of the Customer in writing except for the following purposes:
- a) Billing or Market Operation
- b) Law enforcement
- c) When past due accounts of the Customer have been transferred to a debt collection agency
2.11 Supplier shall take all reasonable steps to ensure a regular and consistent supply of PNG to the Customer however in the event of any interruption due to force majeure like natural calamities, war and other unforeseen events etc. beyond the control of Supplier, the Customer shall have no claim whatsoever for the interruption of the supply however the Supplier as a prudent city gas distribution company shall make all efforts to restore the PNG supply at the earliest.
2.12 The Supplier shall inform the Customer through RWA/Managing committee of the affected society/area/colony of any planned shut down for undertaking maintenance activity in their respective areas. Independent Households will be informed through electronic medium/sms/notice/phone etc.
2.13 Supplier reserves the right to withdraw or disconnect the supply of Gas at any time in the event of any emergency without notice, in which case, Supplier shall not be responsible for any loss, whatsoever.

3.Customer Rights and Obligations:

3.1 Customer shall pay through cheque/Demand draft/ Pay order/Online payment in accordance with the scheme selected for PNG domestic connection.
3.2 The Customer shall bear the cost of material and labour charges for GI pipe in excess of 10 meters before metering unit & tube/pipe in excess of 5 meters after metering unit including rubber tube as per rates applicable at the time of execution and as declared by the Supplier. Such additional charges will be billed in first invoice of Customer.
3.3 It shall be the responsibility of the Customer to provide access to the route as decided by the Supplier for laying of pipeline inside the boundary wall of the premises of his/her residence. However, in case of flats located in multi storey housing societies the Customer shall arrange NOC if required for laying of pipelines, through the common portions/areas/walls inside of such housing complex from the person/society concerned. In the event of non-receipt of such clearance in a reasonable time, Supplier shall cancel the registration and refund the Security Deposit to the Customer.
3.4 The Customer undertakes to provide the Supplier with the proof of Registration of requisite safety and statutory clearances from the competent authority at the time of registration. The Customer is under obligation to provide all the required documents listed under point no. 3, to the satisfaction of the Supplier at the time of submission of the Registration Form.
3.5 The Customer shall make use of the PNG supply for domestic purpose only and that too in the registered premises only and shall not re-supply to any other person or property under any circumstances.
3.6 All fittings & equipment’s as provided by the Supplier for the purpose of supply of PNG shall remain the property of the Supplier. The Customer shall remain the custodian of such properties and shall ensure the safety of PNG Equipment.
3.7 The Customer will not permit interference with PNG Equipment and supply line by any person not authorized by Supplier. Only the Supplier’s authorized representative will have access to rectify the problem and maintain the equipment. Any unauthorized concealing/ tampering/ relocation of PNG Equipment is not permitted and shall be solely at the risk and cost of Customer. The Supplier reserves the right to discontinue PNG supply in case PNG equipment has been interfered with.
3.8 The Customer shall ensure access to the meter reader authorized by Supplier for periodical meter readings and maintenance checks.
3.9 The Customer shall ensure the proper & timely payment of gas consumption bill including all applicable tariffs decided from time to time in accordance with the PNGRB regulations 2008. Customer shall make full payment against the bill raised by the Supplier within 21 days from the date of billing. Any default in the payment may attract a penal interest. Non-receipt of PNG consumption bill shall not be sufficient ground for non-payment of bills. In case Customer has not received Bi-Monthly bill he/she is under obligation to obtain a duplicate copy of same from the Supplier.
3.10 In case of Nil consumption or consumption up to the applicable minimum charges during a billing cycle, Customer shall pay a minimum charge. Alternatively, Customer may request Supplier for temporary disconnection for such period of non-usage of Gas, with payment of applicable disconnection charge per case. Such charges are as per Tariff Card and shall be updated, time-to-time by Supplier.
3.11 In case the Customer fails to pay two consecutive bills Gas supply will be discontinued without any notice. The supply shall only be resumed by Supplier after clearance of all the outstanding bills with applicable interest, and payment of reconnection charges by Customer. In such case, Supplier reserves the right to resume PNG supply.
3.12 All the payments shall be made by as per the modes evolved by the Supplier from time to time. Following modes of payment shall be acceptable by the supplier:
- a) Cheques
- b) Demand Draft
- c) Electronic Fund Transfer
- d) Internet banking/UPI
- e) RTGS, etc.
3.13 The Customer in addition to the per unit cost of Gas shall pay taxes levied as applicable from time to time.
3.14 Supplier may install a smart card enabled gas meter as part of PNG Installation and the same shall be acceptable the Customer without any objections.
3.15 In case the Customer desires to surrender the PNG connection the Customer would be required to submit a written request along with the original receipts of payment made towards the payment of refundable Security Deposit.
3.16 Customer understands the rubber tube is a consumable component of PNG Installation. Customer shall also ensure that if at any time during the usage/non-usage of PNG connection, any damage is detected in the rubber tube, PNG supply should be stopped immediately and a request for replacement of damaged rubber tube with applicable charges should be placed with the Supplier. No request for compensation/ adjustment in the PNG consumption bill on account of leakage of Gas caused due to damage of rubber tube shall be entertained.

4.Termination:

4.1 Without prejudice to other rights of the Supplier in law or otherwise, the Supplier may at any time and with prior notice terminate the Gas supply of the Customer if:
- a) Customer fails to pay the Supplier any sum due to the Supplier under these Terms and Conditions and/or otherwise within 30 days from the due date for payment thereof; or
- b) The Customer fails to comply with any of its obligations and/or commits any breach of the covenants or conditions on his part to be observed, performed or fulfilled: or
- c) The particulars as furnished by the Customer in the Application are found to be false or incorrect; or
- d) In the event of Customer’s demise and no adult successor submits to the Supplier the necessary documents within such reasonable time as required by the Supplier from the happening of such an event or if the Customer becomes insane or insolvent.
4.2 The Customer may, by written notice of 3 months to the Supplier, request termination of the Gas supply. In case the Customer desires immediate disconnection or within three months of start of connection, no charges paid by the Customer to the Supplier shall be refunded.
4.3 In the event of termination of the Gas supply, without prejudice to the other rights of the supply, the Customer shall be liable to pay all amounts due and payable by the Customer to the supply up to the date of termination of Gas supply and costs due.

5.Reconnection:

5.1 After termination/stoppage of the Gas supply, if the Customer applies for reconnection of the Gas supply, all reconnection / re-commissioning contribution (as determined by the Supplier) shall be borne and paid by the Customer.
5.2 Reconnection of Gas supply will be at sole discretion of the Supplier and if the supplier refuses to provide reconnection to the Customer, the same shall be conveyed to the Customer with reasons for refusal of reconnection.

6.Amendment:

6.1 The Supplier reserves its right to amend, add or delete all or any of these terms and conditions at any time and such amended Terms and Conditions shall be binding on the Customer with immediate effect.
6.2 Supplier shall be at liberty to vary, alter, modify and/or revise any charges specified in this regard from time to time and in such event revised charges shall be applicable and binding upon the Customer irrespective of the registration of the Customer prior to the revised charges.

7.Transfer of connection:

7.1 Supplier may permit transfer of the PNG connection from one name to another name in the event of sale /purchase of the Property or demise of the registered Customer.
7.2 The transfer is permitted subject to the payment by the Customer and in event of the Customer’s demise, by any of the Customer’s adult successor (who is seeking transfer of the PNG connection) to Supplier of administrative charges, as may be applicable, from time to time as informed by the Supplier.
7.3 The transfer of PNG connection from one name to another name is subject to the submission of necessary documents, as may be required by Supplier and will be effective only upon full satisfaction of Supplier.
7.4 All terms and conditions stated herein shall be binding on such successor or transferee as the case may be.

8. General:.

8.1 Supplier reserves the right to reject any application for registration by intimating the basis for rejection of the application to the Applicant.
8.2 Supplier reserves the right to provide an additional PNG connection at market price for use in heating and cooling application (i.e. domestic geyser & air conditioner) on request of the Customer along with the payment of applicable charges (Non-Refundable) as prevailing at the time of receipt of such request & additional connection for gas based gensets for domestic supply purposes.
8.3 Prices of domestic PNG are subject to change and Supplier reserves the right to revise the prices at any time.
8.4 The Supplier reserves the right to revise LMC charges and network tariff for the last mile connectivity (LMC) at any time such charges and tariffs would be in accordance with the PNGRB regulations 2008 and any amendments thereto, if any.
8.5 Charges payable by the Customer, for various service requirements of Customers, and/or other cases, shall be as listed in Annexure -2 (these charges are subject to time-to-time revision by Supplier). Supplier shall provide such services to Customer, on receipt of such request and payment of applicable charges (Non-Refundable) by Customer, as prevailing at the time of receipt of such request.
8.6 Supplier reserves the right to amend/modify any or all of the terms and conditions with intimation to the Customer.
8.7 The Supplier reserves the right to supply PNG to other Customers through the same pipeline at any point therein up-to the meter outlet/isolation valve without affecting the Customer’s PNG supply.
8.8 All disputes or difference whatsoever, arising out of this agreement which are not settled by mutual consultation shall be settled by arbitration under the Indian Arbitration & Conciliation Act1996. For the purpose of appointing the sole arbitrator the Supplier shall send to the Customer names of 3 (three) independent persons, and the Customer shall select any one of them to be appointed as “Sole Arbitrator” and communicate his /her name to the Supplier who within thirty (30) days shall appoint the selected person as the “Sole Arbitrator”. In the event of failure of the Customer to select such a “Sole Arbitrator” in terms enumerated above, Supplier reserves a right to appoint one person from names of three persons so sent to the Customer.
8.9 Notwithstanding any other court(s) having jurisdiction to try these suits arising out of this agreement only court of Delhi shall have exclusive jurisdiction to try such suits to the exclusion of all courts in the country.
8.10 Any notice to the Customer will be sent to the address of the Customer stated in his Application, under point 1.
